Giving out tacos at polling place is not illegal, a California Judge has ruled in a case in which a council man was accused of electioneering during polling day by parking his truck and giving out tacos to voters. This article is by Aldo Toledo in Mercury News:
Councilman Antonio Lopez was not violating any election laws when he paid to park a food truck and hand out free tacos at a polling place on election day, a San Mateo County judge has tentatively ruled.
Ahead of a final decision slated for March 24, Superior Court Judge Danny Chou tentatively sided with Lopez and East Palo Alto City Clerk Walfred Solorzano. He said the law is clear that electioneering only happens when a voter is offered something in exchange for voting for a particular candidate or ballot measure.
“It does not prohibit the offering of consideration just for voting,” Chou said, adding that the taco truck that Lopez parked at the St. Francis of Assisi Church polling place on election day did not constitute electioneering.
