Courts have played a crucial role in redistricting over the past few decades, helping to ensure that districts are fair and representative of the people within their boundaries. In particular, the U.S. Supreme Court, as the high court of the United States, has provided various legal principles that reshaped redistricting litigation.
A series of key rulings during the early 1960s established the role of courts in redistricting cases, which Chief Justice Earl Warren later concluded were the most important cases decided during his tenure. While the Supreme Court has nixed the ability to challenge partisan gerrymandering cases in federal court, it has set important precedent in protecting (and sometimes weakening) minority voting rights in racial gerrymandering cases.
